In this notice, “we”, “us” and “our” means Skechers USA Benelux B.V., being the entity proposing to employ you, and we are committed to respecting your privacy. As part of that commitment, Skechers is providing you with this Candidate Privacy Notice to help you understand our privacy policies and practices as they relate to the personal information that Skechers collects about our Dutch job applicants.
We are a "controller" in relation to personal information. This means that we are responsible for deciding how we hold and use personal information about you. You are being sent a copy of this privacy notice because you are applying for work with us (whether as an employee, worker or contractor). It makes you aware of how and why your personal information will be used, namely for the purposes of the recruitment exercise, and how long it will usually be retained for. It provides you with certain information that must be provided in compliance with data protection laws, including but not limited to the European Union’s General Data Protection Regulation (EU GDPR) and the UK General Data Protection Regulation (UK GDPR).
Data protection principles
We will comply with data protection law and principles, which means that your data will be:
- Used lawfully, fairly and in a transparent way.
- Collected only for valid purposes that we have clearly explained to you and not used in any way that is incompatible with those purposes.
- Relevant to the purposes we have told you about and limited only to those purposes.
- Accurate and kept up to date.
- Kept only as long as necessary for the purposes we have told you about.
- Kept securely.
Personal information that we collect about you
Skechers will collect and process (e.g. obtain, record, use, share or hold etc.) the information which are necessary to assess your professional skills and competences and your ability to perform the job for which you apply. This will include:
- Information that you provide to us or one of our affiliates. This includes information about you that you give to us by filling in forms or by communicating with us, whether face-to-face, by phone, email or otherwise through the recruitment process. This information may include:
- your full name, date of birth, gender, nationality, education and qualification details, marital status, home address and home telephone number, email address, mobile telephone number and device type, the information you have provided on your application form, your CV or resume (including qualifications, employment and education history, and your job application(s) to us), any information you provide to us during the interview process, proof of right to work, driving licence information (if applicable); and
- your LinkedIn Profile URL (if you choose to provide it).
- Information we collect or generate about you. This includes:
- personal data that we collect through your communication and correspondence with us (including but not limited to the content, date and time of your email correspondence);
- information obtained through any interviews and assessments with you; and
- personal information that we collect through your conduct at our premises, including but not limited to dates and records from building or door access cards.
- Information we obtain from other sources, such as from as recruitment agencies, online recruitment platforms and professional social media platforms. This may include:
- personal information that is provided or generated by third party recruitment platforms we use in order to process candidate data and provide analysis including ratings and scores to assist in recruiting decisions. The personal information processed includes candidate resumes, (including qualifications, employment and education history, and your job application(s) to us) as well as interaction data from career sites;
- information relating to your identity and contact details, professional activities, competences and skills which is strictly necessary to assess your application and that you have published on professional social media such as LinkedIn or Indeed;
- information obtained for a reference person that we may contact in the context of your hiring process (as required and in accordance with local laws).
How we will use information about you
Your personal data may be stored and processed by Skechers prior to entering a contractual relationship with you in order to:
- consider the application that you provided to us and assess your capabilities and qualifications for the job to which you apply; and
- communicate with you and provide you with updates on the recruitment process, potential interviews, information you requested about the job and our activities, and if your application is retained, providing you with a job offer.
Skechers may also have the legal obligation to process your personal data, in order to perform appropriate formalities required by applicable law or regulation, for instance if any verifications of your right to work in the relevant country are required.
In the event that you do not provide the information necessary for our contractual relationship and/or which are required under the applicable legislation, we may not be able to further pursue the assessment of your job application, and we might not be able to hire you.
Skechers will also process your personal data when it is justified by our legitimate business interests (or the legitimate interests of one or more of our affiliates), and in particular:
- organising your registration on our Careers page and using its features to allow you to search and apply for jobs at Skechers in order to ensure that the recruitment process is efficient and that appropriate candidates for a job are effectively identified;
- sharing information relating to your application with other affiliates of the Skechers Group in order to maintain consistent practices and procedures with respect to the recruitment of personnel across the Skechers Group;
- monitoring your use of the Careers page in order to protect the security and stability of the Careers page;
- where necessary, exercising appropriate legal actions and remedies for the establishment, exercise and defence of Skecher’s legal claims;
- where necessary, enabling due diligences operations carried out by a third party, and more generally the operations relating to the transfer of our activities in a context of transactions or operations on Skecher’s assets or activities which are performed to ensure the group’s profitability and viability.
Please note, if your application is successful and you are subsequently offered and accept employment at Skechers, the information we collect during the application and recruitment process will be used for the purpose of the hiring process and mandatory formalities, and it will also become part of your employment record.
If your application is not successful, we may retain your application data for up to two years after the end of the recruitment process so that we can notify you of relevant future job vacancies. We rely on our legitimate interest in identifying and contacting suitable candidates for future opportunities. You may object to this processing at any time by contacting us in accordance with the “Contacting us” section below.
How we use particularly sensitive personal information
Where appropriate we will use your particularly sensitive personal information in the following ways:
- We use information about disability to consider whether we need to provide appropriate adjustments during the recruitment process, for example whether adjustments need to be made during an interview.
- We use information about racial or ethnic origin, religious or philosophical beliefs, disability or sexual orientation to ensure meaningful equal opportunity monitoring and reporting.
Automated decision-making and profiling
You will not be subject to decisions that will have a significant impact on you based solely on automated decision-making. We use third party software tools to assist in processing candidate data and to provide ratings and scores to assist in recruitment decisions but do not make autonomous hiring decisions without human review. The providers of any third party tools act as a data processor on behalf of Skechers, processing candidate data to provide services such as candidate matching, scoring, and recruitment analytics.
Please note that where third-party tools use artificial intelligence ("AI”) to assist us in the recruitment process, this helps us with certain processing activities including to:
- match candidates or prospective candidates to open vacancies; and
- enable more effective review of candidates’ or prospective candidates’ profiles if permitted by applicable law.
The processing of your data by AI will involve profiling operations concerning you. Profiling involves analysing the data we have collected about a given individual in order to evaluate certain personal aspects, such as performance at work. The AI tools we use will analyse the content of the information provided as part of your application and categorise your application to assess how well it matches the position you are applying for. This categorisation will help guide HR managers in reviewing the applications they receive.
Through the implementation of this profiling, we pursue our legitimate interest in efficiently managing the large volume of applications we regularly receive. You may object at any time to the processing of your data for profiling purposes by submitting a request to the service indicated in the 'Contact us' section below.
Data sharing
Why might you share my personal information with third parties?
We may disclose your personal information to our affiliates for the purposes of:
- the management and administration of our business and our affiliates’ business;
- complying with the functions that each of them may perform relating to regional or global HR decisions;
- assessing compliance with applicable laws, rules and regulations, and internal policies and procedures across our business and our affiliates’ businesses; and
- performing contractual obligations with third-parties; and
- the administration and maintenance of the databases storing personal information relating to candidates.
We will take steps to ensure that the personal information is accessed only by employees of our affiliates that have a need to do so for the purposes described in this Privacy Notice and that they are subject to appropriate confidentiality and only use the data for purposes described in this Privacy Notice.
We may also share your personal information to third parties outside of our corporate group for the following purposes:
- if we sell any of our business or assets, in which case we may disclose your personal information to the prospective buyer for due diligence purposes;
- if we are acquired by a third party, in which case personal information held by us about you will be disclosed to the third party buyer;
- to process candidate data and provide analysis including ratings and scores to assist in recruiting decisions;
- to third party agents and contractors for the purposes of providing services to us, including, IT and communications providers, law firms, accountants and auditors. These third parties will be subject to confidentiality requirements and they will only use your personal information as described in this privacy notice; and
- to the extent required by law, for example if we are under a duty to disclose your personal information in order to comply with any legal obligation, establish, exercise or defend our legal rights.
All our third-party service providers and other entities in the group are required to take appropriate security measures to protect your personal information in line with our policies. We do not allow our third-party service providers to use your personal information for their own purposes. We only permit them to process your personal information for specified purposes and in accordance with our instructions.
Data security
We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need-to-know. They will only process your personal information on our instructions and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected data security breach and will notify you and any applicable regulator of a suspected breach where we are legally required to do so.
Data retention
How long will you use my information for?
The length of time that we hold your personal data will vary. The retention period will be determined by the following criteria:
- if your application is successful:
- as long as necessary in relation to your employment with Skechers; and
- after your employment has ended, as long as Skechers is subject to respective legal obligations because (laws or regulation may set a minimum period for which we have to store your personal data; and
- if your application is unsuccessful: we will keep your data for a maximum period of two years from the end of the recruitment process so that we can inform you of future vacancies unless you ask us to delete your data and/or object to their processing for this purpose (as further described below).
After this period, we will securely destroy your personal information in accordance with our data retention policy.
Transfers of personal information outside the European Economic Area
Your personal information may be transferred to our international affiliates and the various entities that make up our international network and accessed by personnel authorised by us, and in limited circumstances to our third-party contacts, outside the European Economic Area (“EEA”) as well as within it, for the purposes identified above. Specifically, your personal information is shared with Skechers U.S.A. Inc. in the United States and Skechers S.a.r.l. in Switzerland to administer your potential employment contract and manage our potential employment relationship with you. Those entities provide corporate shared services to Skechers subsidiaries located around the world. To provide these services, it is sometimes necessary for Skechers subsidiaries to share data about the subsidiaries’ candidates with the parent companies. Where we transfer your personal information outside the EEA, it will be protected in a manner that is consistent with how your personal information will be protected by us in the EEA. This can be done in a number of different ways, for instance:
- the country to which we send the data is approved by the European Commission as offering an adequate level of protection of your personal information;
- the recipient may have adhered to binding corporate rules (only for intragroup transfers); or
- the recipient has signed a contract based on model contractual clauses as approved by the European Commission or other data protection authority, obliging them to protect your personal information.
The personal information that we collect from you may be transferred to, and stored at, destinations outside the EEA. It may also be processed by individuals operating outside of the EEA who work for our affiliates or for one of our suppliers.
In all cases, however, we will ensure that any transfer of your personal information is compliant with the applicable data protection law.

Rights of access, rectification, erasure, objection, restriction and data portability
Your rights in connection with personal information
Under certain circumstances, by law you have the right to:
- Request access to your personal information (commonly known as making a "data subject access request"). This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.
- Request rectification of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected.
- Request erasure of your personal information. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal information where you have exercised your right to object to processing (see below).
- Object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground. You also have the right to object where we are processing your personal information for direct marketing purposes.
- Request the restriction of processing of your personal information. This enables you to ask us to suspend the processing of personal information about you, for example if you want us to establish its accuracy or the reason for processing it.
- Receive your personal data in a structured, commonly used and machine-readable format and/or request the transfer of your personal information to another party.
- Lodge a complaint with the data protection regulator (details of which are provided below) if you think that any of your rights have been infringed by us.
